{"id":38633,"date":"2025-06-10T13:33:02","date_gmt":"2025-06-10T11:33:02","guid":{"rendered":"https:\/\/getitmagazine.co.za\/ballito-umhlanga\/?p=38633"},"modified":"2025-06-10T15:43:46","modified_gmt":"2025-06-10T13:43:46","slug":"summary-of-aspen-v-adcock-2025-017055-25","status":"publish","type":"post","link":"https:\/\/getitmagazine.co.za\/ballito-umhlanga\/blog\/2025\/06\/10\/summary-of-aspen-v-adcock-2025-017055-25\/","title":{"rendered":"Summary of Aspen v Adcock [2025]"},"content":{"rendered":"<p>The case of Aspen Pharmacare Holdings Group &amp; Pharmacare Limited v Adcock Ingram Healthcare (Pty) Ltd &amp; Adcock Ingram Intellectual (Pty) Ltd, was recently heard in the High Court and judgment was delivered on May 12.\u00a0 Both Aspen and Adcock are prominent pharmaceutical groups in South Africa, each with a holding company and subsidiaries managing their intellectual property.<\/p>\n<p>The facts, in brief, were that Aspen is the registered proprietor of the trademark: \u2018MYBUCOD\u2019, registered in 2008 and used for 17 years without interference or challenge.\u00a0 In January 2025, Aspen discovered that Adcock had launched a competing pharmaceutical product under the name: \u2018LENBUCOD\u2019, and had applied to register this name as a trademark.<\/p>\n<p>Aspen sought an interdict and related orders to prevent Adcock from selling \u2018LENBUCOD\u2019, arguing that the name was confusingly similar to \u2018MYBUCOD\u2019, and amounted to trade mark infringement. Adcock opposed the application, contending that Aspen\u2019s trade mark was invalid and should not have been registered, as \u2018BUCOD\u2019 was allegedly a non-distinctive, descriptive term derived from the name of the active ingredients ibuprofen and codeine.<\/p>\n<p>The court considered whether \u2018LENBUCOD\u2019 was likely to deceive or cause confusion among consumers in relation to \u2018MYBUCOD\u2019.<br \/>\nThe analysis focused on:<\/p>\n<ul>\n<li><strong>Similarity of marks:<\/strong> Both marks share the distinctive root: \u2018BUCOD\u2019, which had no prior commercial use before Aspen\u2019s registration. The court found that the dominant feature of both marks was \u2018BUCOD\u2019, and that even with any prefix or suffix, any composite mark would inevitably be associated with Aspen\u2019s products.<\/li>\n<li><strong>Consumer perception:<\/strong> The products are only available through pharmacies and with the assistance of a pharmacist, but consumers often recall and request products by the dominant part of the name. Evidence from a practising pharmacist supported the view that \u2018BUCOD\u2019 would be associated with Aspen\u2019s products.<\/li>\n<li><strong>Market context:<\/strong> For 17 years, only Aspen\u2019s products used \u2018BUCOD\u2019, so the introduction of \u2018LENBUCOD\u2019 would likely cause confusion or deception regarding the source or origin of the product.<\/li>\n<li><strong>Legal precedents:<\/strong> The court referred to several past cases, emphasising that the presence of a common, distinctive element in trademarks is significant in assessing the likelihood of confusion.
