{"id":45116,"date":"2025-07-22T12:14:25","date_gmt":"2025-07-22T10:14:25","guid":{"rendered":"https:\/\/getitmagazine.co.za\/highway-berea\/?p=45116"},"modified":"2025-07-22T12:14:25","modified_gmt":"2025-07-22T10:14:25","slug":"social-lawyer-fights-for-justice-and-equity","status":"publish","type":"post","link":"https:\/\/getitmagazine.co.za\/highway-berea\/blog\/2025\/07\/22\/social-lawyer-fights-for-justice-and-equity\/","title":{"rendered":"Social Lawyer fights for justice and equity"},"content":{"rendered":"<p>At just 30, Unathi Dlamini is rewriting the narrative of what it means to be a young woman in South African law.<\/p>\n<p>Elected as the new president of the KZN Chapter of the South African Society for Labour Law (SASLAW), Unathi is not only breaking ground in employment and social media law, but she\u2019s also deeply rooted in community work &#8211; advocating for fairness, access to justice, and empowering the vulnerable.<\/p>\n<p>Based in Umhlanga, and working with one of Durban\u2019s leading legal firms, Unathi brings a powerful mix of passion, professionalism and principle to her growing list of accomplishments. But it\u2019s the clarity of her \u2018why\u2019 and her commitment to justice, equity and empathy that sets her apart.<\/p>\n<p>\u201cBeing elected as president was both a personal and professional milestone,\u201d she says. \u201cIt affirmed that the work I\u2019ve put in hasn\u2019t been in vain. It\u2019s an honour to be trusted to lead such an important provincial chapter.\u201d<\/p>\n<p>Unathi\u2019s love for employment law sparked during her third year at university, when a labour law module revealed the intersectional power of law as both a tool for individual advocacy and systemic change.<\/p>\n<p>\u201cIn my final year, my moot court topic was on the constitutionality of affirmative action. That moment cemented it for me as the area where I want to make my mark.\u201d<\/p>\n<p>Since then, she has carved out a niche in the nuanced world of employment and social media law, with a special interest in how evolving digital spaces affect the modern workplace.<\/p>\n<p>\u201cDigital rights governance is critical,\u201d she says. \u201cIt\u2019s the framework for everything from POPIA compliance to social media policies. Both employers and employees need to know their rights and responsibilities.\u201d<\/p>\n<p>She says employment law is deeply personal as it often deals with people\u2019s livelihoods, identities and dignity. For Unathi, staying grounded in such emotionally charged work means remembering the bigger picture.<\/p>\n<p>\u201cFirst and foremost, I\u2019m an officer of the court,\u201d she explains. \u201cMy job is to bring calm to the chaos, to advocate ethically, and help people navigate some of the most difficult moments in their lives.\u201d<\/p>\n<p>She recalls one particularly resonant case &#8211; securing a protection order for a client and their business after being harassed on social media.<\/p>\n<p>\u201cThat case showed how real the consequences of online behaviour can be. To help someone feel safe again, both personally and professionally, is why I do what I do.\u201d<\/p>\n<p>Unathi\u2019s legal career doesn\u2019t end in the boardroom. Her work with Wylie House Child and Youth Care Centre, based in Berea, and with ProBono.Org reflects her deep commitment to justice beyond formal legal spaces.<\/p>\n<p>\u201cThe knowledge we gain as attorneys is a privilege, and it should be used for the greater good,\u201d she says. \u201cI believe in being a villager. You can\u2019t build a village if you\u2019re not part<\/p>\n<p>of it.\u201d<\/p>\n<p>She sees her community work and legal career as deeply connected, explaining that it\u2019s about access and ensuring that the most vulnerable &#8211; from at-risk girls to low-wage workers &#8211; aren\u2019t left behind.<\/p>\n<p>\u201cLabour legislation in South Africa is progressive, but not everyone benefits equally. We all have a role to play in making sure those rights are lived, not just written.\u201d<\/p>\n<p>Despite her many titles and roles, Unathi remains firmly herself &#8211; joyful, reflective and purpose-driven. Her beach walks, spontaneous road trips for the best cappuccino, and hilariously long voice notes to friends are just as central to her identity as any courtroom win.<\/p>\n<p><em>\u201cWhen I become excellent, it won\u2019t be accidental &#8211; I will have laboured. <\/em>That\u2019s a quote I live by. It keeps me grounded, especially on days when imposter syndrome creeps in.\u201d<\/p>\n<p>She also challenges the pressure to conform in traditionally male-dominated spaces.<\/p>\n<p>\u201cWomen are often told to \u2018toughen up\u2019 or \u2018be more aggressive.\u2019 But I\u2019ve found strength in being myself. Excellence doesn\u2019t need a performance &#8211; it just needs to be undeniable.\u201d<\/p>\n<p>For Unathi, Women\u2019s Month is a time to reflect, honour and keep building. She sees herself as part of a lineage &#8211; one that includes generations of women who have fought for justice, equality and inclusion.<\/p>\n<p>\u201cGatekeeping isn\u2019t cute,\u201d she says with a smile. \u201cPlatform others. Uplift. The freedoms we have were hard-won. Let\u2019s take up space and make room too.\u201d<\/p>\n<p>Her advice for young women in law is direct and heartfelt:<\/p>\n<p>\u201cBe intentional. Be consistent. Ask questions. Show up. If unclear, seek advice.<\/p>\n<p><strong>Know your rights and responsibilities<\/strong> South Africa\u2019s labour laws protect both parties. Make sure you understand how they apply to you.<\/p>\n<p><strong>Social media conduct counts<\/strong> What you post online &#8211; even outside of working hours &#8211; can impact your job. Be cautious and professional on all platforms.<\/p>\n<p><strong>Document everything<\/strong> Keep records of performance reviews, complaints, warnings and changes to your employment terms.<\/p>\n<p><strong>Probation periods matter<\/strong> If you\u2019re under probation, remember you\u2019re still entitled to fair labour practices. It\u2019s not a \u2018free-for-all\u2019 for employers.<\/p>\n<p><strong>Dismissals must be fair<\/strong> Both procedurally and substantively. If you\u2019re dismissed unfairly, you can approach the CCMA within 30 days.<\/p>\n<p><strong>You can access legal help<\/strong> Through SASLAW Pro Bono NPC at Labour Courts across South Africa, and ProBono.Org in major provinces &#8211; visi<em>t ProBono.org.za<\/em><\/p>\n<p><strong>Don\u2019t sign under pressure<\/strong> If you\u2019re given a contract or document to sign immediately, ask for time to review it properly.<\/p>\n<p><strong>Your health and safety is protected<\/strong> Employers must provide a safe working environment. Report violations to the Department of Labour.<\/p>\n<p><strong>Ask.
